Who Needs This Service?

Under the Air & Water (Prevention and Control of Pollution) Acts, any business discharging emissions or waste requires SPCB clearance. CPCB classifies units into four categories:

  • Red Category (High Pollution Index): Heavy manufacturing, chemical industries, pharmaceutical bulk drugs, and metallurgical plants. (Requires strict CTE and CTO approvals).
  • Orange Category (Medium Pollution Index): Food processing, print presses, textile printing, machinery assembly, paint workshops, and mid-sized manufacturing units. (Requires CTE & CTO).
  • Green Category (Low Pollution Index): Dry-cleaning, cardboards, small-scale assembling, and flour mills. (Requires simple approvals/renewals).
  • White Category (Non-Polluting): IT units, medical clinics, assembly of solar plates. (Exempted from CTE/CTO, only requires a basic online declaration submission).

Consequences of Non-Compliance

Operating an industrial process without State Pollution Control Board clearance violates environmental laws, carrying severe statutory punishments:

  • Utility Disconnection: SPCB officers can order immediate factory closure, along with disconnection of industrial electricity and water supplies.
  • Accruing Penalties: Financial penalty fines of up to ₹10,000 per day for operating without active consent or discharging unpermitted emissions.
  • Imprisonment Term: Criminal liability and imprisonment of directors/partners for a mandatory term between 1.5 to 6 years.

Required Documentation Checklists

Keep these technical layouts and project files ready for SPCB verification:

  • Detailed Project Report (DPR) explaining manufacturing process and raw material balances
  • Land allocation deeds, ownership registry, or registered rent/lease agreements
  • Design engineering layouts for Effluent Treatment Plant (ETP) or Sewage Treatment Plant (STP) (if discharging effluents)
  • Air pollution control system details (Chimney heights, filter dimensions, boiler fuel capacity data)
  • Copy of Consent to Establish (CTE) (required when applying for the subsequent Consent to Operate - CTO)
