Who Needs This Service?

Under the Employees' State Insurance Act, 1948, ESI registration is mandatory for:

  • Non-seasonal factories and businesses employing 10 or more individuals (in some territories the threshold remains 20).
  • Applicable to all employees drawing gross salaries or wages up to ₹21,000 per month (₹25,000 for employees with physical disabilities).
  • Shops, restaurants, hotels, road-motor transport, cinemas, newspaper establishments, and private educational/medical institutions.

Consequences of Non-Compliance

Any non-remittance, incorrect wage calculations, or delay in deposit triggers penalties under the ESIC Act:

  • Interest under Section 39(5): Mandatory interest rate of 12% per annum on the amount due for each day of default.
  • Punitive Damages (Reg 31C): Escalating penalty damages up to 25% of the total outstanding dues for chronic late filers.
  • Prosecution under Sec 85: Failure to remit employee deductions carries mandatory imprisonment terms between 1 to 3 years.

Required Documentation Checklists

The following structural certificates and data sheets are required to complete the registration:

  • Shop & Establishment Certificate / License or Certificate of Incorporation
  • Company PAN Card and GSTIN details
  • Cancelled cheque displaying company name, account number, and IFSC
  • Employee list (Details: Name, Father's Name, DOB, Aadhaar, PAN, Bank Details, and joining date)
  • Individual passport size photograph of all employees needing ESIC insurance cards
