Who Needs This Service?
Under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, registration and cess payment is mandatory for:
- Any construction employer employing 10 or more building workers on any day during the preceding 12 months in any building or construction work.

- Firms executing government civil contracts or infrastructure works, where the BoCW registration certificate is an absolute prerequisite to release bills.
Consequences of Non-Compliance
Failure to register construction projects or delay in paying the construction cess leads to severe enforcement measures by the Labour Department:
- Cess Penalty Interest: 1% to 2% construction welfare cess is mandatory. Late payments attract an interest penalty of 2% per month on the unpaid cess amount.
- Work Stoppage: Labour Commissioners have powers to issue immediate stop-work notifications on the construction site.
- Prosecution & Fines: Legal proceedings against project directors and partners, including potential imprisonment for up to 3 months or fine up to ₹1,000.
